Bilberry Terms of Service

1. Service Provider

The Bilberry application (bilberry.health) is operated by Dariusz Gugała — a sole trader registered in the Polish CEIDG register (legal name: "Dariusz Gugała"), trading under the brand two71 — Wrocław, NIP 8961368047, REGON 366648559, e-mail: kontakt@two71.io. This address is also the point of contact for users and authorities within the meaning of the Digital Services Act (DSA); communication: Polish and English.

2. What Bilberry is

Bilberry is a web application (PWA + Android app) that supports a healthy lifestyle: an AI-assisted food diary, calculation of a calorie target from your body-weight trend, weekly meal plans with shopping lists, storage and tracking of laboratory test results, daily summaries, and an AI assistant. AI-generated content is marked in the interface as a proposal and requires your confirmation before anything is saved.

Bilberry is not a medical device and is not intended for diagnosing, treating, alleviating or preventing disease. All content — including meal plans, nutrition guidance related to lab results, notes and assistant answers — is of a purely informational and educational nature and does not constitute medical advice, diagnosis or therapy. Using the application does not create a physician–patient relationship. Never disregard medical advice, or delay in seeking it, because of content from the application. In a health emergency, contact a physician or call 112.

2a. Health and safety

Consult a physician before you start if: you are under medical treatment (especially for diabetes, kidney, heart or thyroid disease), you take prescription medication, you are pregnant or breastfeeding, or you are under 18 years of age. Weight reduction is not appropriate for everyone.

Eating disorders. The application is meant to serve a healthy relationship with food. It must not be used to achieve or promote a dangerously low energy intake. If you have, or suspect you have, an eating disorder, calorie counting may harm you — talk to a physician or a psychologist; free support: the crisis helpline 116 123 (Poland). If you feel this application is not for you — do not use it.

Allergies and intolerances. Exclusions ("can't have") are enforced by the application automatically during planning, but product composition data — from food databases and from AI recognition — may be incomplete or out of date. In the case of a life-threatening allergy, always verify the ingredients on the product packaging.

Data are estimates. Nutritional values (from the food database and from AI recognition of photos/descriptions) and lab-result readings are estimates and may contain errors — that is why every AI output requires your confirmation (section 9).

3. Account

4. Rules of use and AI fair use

The following are prohibited: using the application in a way that violates the law, attempting to circumvent security measures or gain access to other people's data, automated querying (scraping), and actions that disrupt the operation of the service.

Fair use of AI features. The AI features are intended for personal, non-commercial use as part of normal use of the application. The following in particular are prohibited: querying the AI features in an automated manner, using them for purposes unrelated to the application (e.g. as a general AI chat for third parties), reselling or sharing access, and account sharing. To ensure stability and a fair allocation of resources, all plans — including Premium — have generous usage budgets (a monthly AI budget, a daily limit on new image generations and a query rate limit), set so as not to restrict normal, personal use; the current values are described in the application. AI features require a verified e-mail address. In the event of abuse we may restrict the AI features or apply section 4b.

4a. Your content

The content you enter into the application (meal photos, diary entries, lab results, notes) remains your property. You grant us a non-exclusive, non-transferable licence limited solely to providing the service — including processing by the providers indicated in the Privacy Policy (e.g. meal recognition by an AI model). The licence expires when the content or the account is deleted. We do not use your content to train AI models — neither our own nor anyone else's; our AI providers are bound by agreements that exclude training on this data.

4b. Account suspension and termination by the Provider

We may suspend an account or terminate the agreement in the event of a material breach of section 4 or of the law. We will state the reason; you may appeal the decision at kontakt@two71.io. Unless the law provides otherwise, we will enable a data export before the account is deleted. Fees for the unused portion of a paid plan are refunded proportionally, unless the termination resulted from a gross violation of the law or of these Terms.

5. Plans and fees

The application operates on a freemium model:

Every new account starts with a 14-day trial period with the full Premium scope — no card required; when it ends, the account switches to the free plan. The prices stated apply to Poland (VAT included); in other EU countries prices are adjusted to local purchasing power and shown before you confirm the purchase. Features already paid for and your data are never blocked retroactively. We will announce price changes at least 30 days in advance — a change does not apply retroactively to a period already paid for and takes effect at the earliest from the next billing period. Plan purchases take place exclusively via the bilberry.health website (Paddle, section 6); the Android app does not collect payments.

5a. Referral program

Every user has a personal referral link in Settings. When a new person creates an account using that link (the referral code may be submitted no later than 48 hours after registration; this applies only to accounts on the free plan):

Rewards take the form of Premium time — they cannot be exchanged for money or transferred to another account. In cases of abuse (fictitious accounts, multiple accounts of the same person, automation) we may refuse to grant, or revoke, rewards obtained in violation of the rules. We may change or end the program with at least 14 days' notice in the application; rewards already granted remain valid.

6. Payments and merchant of record

Paid plans are sold by Paddle (Paddle.com Market Ltd / Paddle Payments Ltd) as the merchant of record — Paddle is the party to the payment transaction, collects the payment, accounts for VAT and issues invoices/receipts. Card details never reach the Service Provider. The subscription renews automatically at the end of the period; you can cancel it at any time in the "Manage subscription" panel (Settings) — access then continues until the end of the paid period and nothing further is charged.

7. Withdrawal and refunds

As a consumer you have the right to withdraw from the purchase within 14 days without giving any reason. A message to kontakt@two71.io or directly to Paddle (paddle.net — buyer support) is sufficient; the refund goes to the original payment method. Starting to use a paid plan during the withdrawal period takes place with your express consent; upon withdrawal we refund the entire fee for the current, first period. After the 14 days have passed, the fee for a period that has begun is non-refundable, but you can cancel the subscription with effect from the end of the period (section 6). Complaints concerning payments are handled jointly with Paddle (section 10).

8. Availability and changes to the service

We strive to keep the service running without interruption, but we do not guarantee its continuous availability (maintenance work, outages, force majeure). Features may change; we will announce material changes to users' detriment in advance.

9. Liability

AI outputs (meal recognition, reading of lab results, plans, assistant answers) may contain errors — that is why every output requires your confirmation, and nutritional values and lab readings should be treated as estimates. The Service Provider is not liable for decisions made solely on the basis of content from the application, subject to any liability towards consumers that cannot be excluded under the law.

10. Complaints

Complaints: kontakt@two71.io. We respond within 14 days. A consumer may also use out-of-court means of handling complaints and pursuing claims, including the assistance of the permanent arbitration courts at the voivodeship inspectorates of the Trade Inspection (Inspekcja Handlowa), district (municipal) consumer ombudsmen and the free consumer helpline — information: uokik.gov.pl and polubowne.uokik.gov.pl. (The EU online dispute resolution (ODR) platform was discontinued in July 2025; information on pursuing consumer claims in the EU: consumer-redress.ec.europa.eu.)

11. Changes to these Terms

We will announce changes to these Terms in the application at least 14 days before they take effect and ask for your acceptance. If you do not accept them, you may stop using the service (with a full export of your data); for paid plans we will then refund a proportional part of the fee for the unused period.

12. Governing law

Polish law is the governing law, which does not deprive consumers of the protection afforded by the provisions of the country of their habitual residence.
